🇬🇧 General Terms and Conditions (GTC)
of Cello del Marketing UG
§1 Scope of Application and Definitions
(1) These General Terms and Conditions apply to all deliveries and services between us and a consumer in the version valid at the time of the order.
(2) A consumer is any natural person who concludes a legal transaction for purposes which predominantly cannot be attributed to their commercial or independent professional activity (§ 13 BGB).
§2 Conclusion of Contract and Storage of Contract Text
(1) The following provisions apply to orders placed via our online shop https://www.halalmusic.de.

(3) The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to submit an offer.
(4) By ordering the products, the consumer submits a binding offer to conclude a purchase contract.
(5) The order process includes the following steps:
- Selection of the desired products
- Confirmation by clicking “Order”
- Review of the shopping cart
- Proceeding to checkout
- Optional registration or guest checkout
- Review and correction of entered data
- Binding submission by clicking “Buy” or “Order with obligation to pay”
Order receipt is confirmed by an automated email. This confirmation constitutes acceptance of the offer.
(6) Contract text storage: Order data and these GTC are sent by email. The GTC are available at https://www.halalmusic.de/agb.
§3 Prices, Payment and Due Date
(1) All prices include statutory VAT. As the products are digital products, no shipping costs apply. Files are provided digitally via email or download.
(2) Available payment methods include PayPal and credit card (Visa, Mastercard), as displayed during checkout.
(3) Licenses offered:
- Private License
- Creator License
- Artist License
- Independent License (on request)
§4 Delivery
(1) Delivery of digital products takes place electronically via email or download link within one business day after receipt of payment.
(2) No physical shipping or transfer of risk applies.
§5 Retention of Title
The digital content remains our intellectual property until full payment has been received.
§6 Right of Withdrawal
Exclusion of the Right of Withdrawal for Digital Content:
For contracts for the supply of digital content not delivered on a tangible medium
(e.g. music files), the right of withdrawal expires once performance has begun,
provided that the customer has expressly consented to the performance beginning
before the end of the withdrawal period and has acknowledged the loss of the right of withdrawal
(§ 356 para. 5 BGB).
§7 Warranty
The statutory warranty provisions apply.
§8 Contract Language
The contract language is German only. This English version is provided for convenience. The German version is legally binding.

§1 Geltungsbereich und Begriffsdefinitionen
(1) Diese Allgemeinen Geschäftsbedingungen gelten für alle Lieferungen und Leistungen zwischen uns und einem Verbraucher in der zum Zeitpunkt der Bestellung gültigen Fassung.
(2) Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbstständigen beruflichen Tätigkeit zugerechnet werden können (§ 13 BGB).
§2 Vertragsschluss und Speicherung des Vertragstextes
(1) Diese Regelungen gelten für Bestellungen über unseren Online-Shop https://www.halalmusic.de.

(3) Die Präsentation der Produkte stellt kein rechtlich bindendes Angebot dar, sondern eine Aufforderung zur Abgabe einer Bestellung.
(4) Mit der Bestellung gibt der Verbraucher ein verbindliches Angebot zum Abschluss eines Kaufvertrags ab.
(5) Der Bestellvorgang erfolgt in folgenden Schritten:
- Auswahl der gewünschten Produkte
- Bestätigung durch Klick auf „Bestellen“
- Prüfung des Warenkorbs
- Zur Kasse gehen
- Optionale Registrierung oder Gastbestellung
- Prüfung und Korrektur der Eingaben
- Verbindliche Absendung der Bestellung
Die Bestellbestätigung per E-Mail stellt die Annahme des Vertrags dar.
(6) Speicherung des Vertragstextes: Bestelldaten und AGB werden per E-Mail übermittelt. Die AGB sind unter https://www.halalmusic.de/agb abrufbar.
§3 Preise, Zahlung und Fälligkeit
(1) Alle Preise enthalten die gesetzliche Umsatzsteuer. Da es sich um digitale Produkte handelt, fallen keine Versandkosten an.
(2) Die verfügbaren Zahlungsmethoden werden im Checkout angezeigt.

§4 Lieferung
(1) Die Lieferung erfolgt ausschließlich digital per E-Mail oder Download-Link spätestens innerhalb eines Werktages nach Zahlungseingang.
(2) Ein physischer Versand oder Gefahrübergang findet nicht statt.
§5 Eigentumsvorbehalt
Die digitalen Inhalte bleiben bis zur vollständigen Bezahlung unser geistiges Eigentum.
§6 Widerrufsrecht
Ausschluss des Widerrufsrechts für digitale Inhalte:
Bei digitalen Inhalten, die nicht auf einem körperlichen Datenträger geliefert werden
(z. B. Musikdateien), erlischt das Widerrufsrecht gemäß § 356 Abs. 5 BGB,
sofern der Kunde ausdrücklich zugestimmt hat und den Verlust des Widerrufsrechts bestätigt hat.
§7 Gewährleistung
Es gelten die gesetzlichen Gewährleistungsbestimmungen.
§8 Vertragssprache
Vertragssprache ist ausschließlich Deutsch. Die englische Fassung dient nur der Information.
